第三條 利率及還款期article 3 interest and term repayment

the borrower risks to bankruptcy or goes bankrupt, closes out, dissolves,has been asked to suspend business to raise standards or has its licenserevoked;

(6)借款方住所或法定代表人發(fā)生變更;

the business place or the legal representative has been changed;

(一)乙方的義務(wù):

1.對甲方交來的做為抵押物的各種契據(jù)和證件要妥善保管,不得遺失,、損毀,。

2.在甲方到期還清貸款后,將抵押的全部契據(jù),、證件完整交給甲方,。

(二)甲方的義務(wù):

1.應(yīng)嚴(yán)格按照合同規(guī)定時(shí)間主動還本付息。

2.保證在抵押期間抵押物不受甲方破產(chǎn),、資產(chǎn)分割,、轉(zhuǎn)讓的影響。如乙方發(fā)現(xiàn)甲方抵押物有違反本條款的情節(jié),,乙方通知甲方當(dāng)即改正或可終止本合同貸款,,并追償已貸出的全部貸款本息。

4.甲方因故意或過失造成抵押物毀損或使抵押物失去抵押作用的,,應(yīng)在天內(nèi)向乙方提供新的抵押物,,若甲方無法提供新的抵押物或擔(dān)保時(shí),乙方有權(quán)解除本合同,,追償已貸出的貸款本息,。

5.甲方未經(jīng)乙方同意不得將抵押物出租,、出售、轉(zhuǎn)讓,、再抵押或以其它方式處分,。

(二)丙方的義務(wù)

1.丙方為甲方在本合同項(xiàng)下貸款提供連帶責(zé)任的保證擔(dān)保,若甲方不能向乙方還貸款本息或因甲方違約而被乙方要求提前清償貸款本息和費(fèi)用時(shí),,丙方將承擔(dān)連帶的清償責(zé)任,,乙方有權(quán)依據(jù)擔(dān)保條款直接向丙方追索

第四條 違約責(zé)任

1.乙方如因本身責(zé)任不按合同規(guī)定支付貸款,給甲方造成經(jīng)濟(jì)上的損失,,乙方應(yīng)負(fù)責(zé)違約責(zé)任,。

2.甲方如未按貸款合同規(guī)定使用貸款,一經(jīng)發(fā)現(xiàn),,乙方有權(quán)提前收回全部貸款,,并對挪用貸款部分在原貸款利率的基礎(chǔ)上加收100%的罰息。

3.甲方如不按期付息還本,,或有其它違約行為,,乙方有權(quán)停止貸款,并要求甲方提前歸還已貸的本息,。乙方有權(quán)從甲方在任何銀行開立的帳戶內(nèi)扣收,,并從過期之日起,對逾期貸款部分按貸款利率加收100%的利息,。

4.甲方如不按期付息還本,,乙方可就做為抵押物的各種契據(jù)和證件做出相應(yīng)處理。直至甲方還清乙方全部貸款本息為止,。

第五條 其它規(guī)定

1.發(fā)生下列情況之一時(shí),,乙方有權(quán)停止發(fā)放貸款并立即收回已經(jīng)發(fā)放的貸款。

(1)甲方向乙方提供的情況,、報(bào)表和各項(xiàng)資料不真實(shí),。

(2)甲方與第三者發(fā)生訴訟,經(jīng)法院裁決敗訴,,償付賠償金后,,無力向乙方償付貸款

(3)甲方的資產(chǎn)總額不足抵償其負(fù)債總額。

(4)甲方的保證人違反或失去合同書中規(guī)定的條件,。

(5)甲方每月_______號前向乙方支付當(dāng)月貸款利息。

2.乙方有權(quán)檢查,、監(jiān)督貸款的使用情況,,甲方應(yīng)向乙方提供有關(guān)報(bào)表和資料。

3.甲方或乙方任何一方要求變更合同或本合同中的某一項(xiàng)條款,,須在事前以書面形式通知對方,,在雙方達(dá)成協(xié)議前,本合同中的各項(xiàng)條款仍然有效。

第六條 爭議的解決

本合同在履行中如發(fā)生爭議,,雙方應(yīng)協(xié)商解決,,協(xié)商不成時(shí),雙方同意由_________仲裁委員會仲裁(當(dāng)事人雙方不在本合同中約定仲裁機(jī)構(gòu),,事后又沒有達(dá)成仲裁協(xié)議的,,可向人民法院起訴)。

本合同一式三份,,甲,、乙、丙各執(zhí)一份,,自________起生效,,具有同等法律效力。
